Playtouch Terms of Service

The Playtouch gaming platform and its associated services, games, applications, and demonstration environments (the "Service") are published and operated by PLAYTOUCH, a simplified joint-stock company (Société par Actions Simplifiée - SAS) with a share capital of 365,500 Euros, registered under French law with the Trade and Companies Register under number RCS 528 099 666, having its registered office at 28 allée des oliviers, Cedex 3, 06330 Roquefort Les Pins, France (alongside its international operating subsidiary PLAYTOUCH Ltd, Mauritius).

By accessing, browsing, registering for, or playing any game on the Service, you unconditionally agree to be bound by these Terms of Service. If you do not accept these terms in their entirety, you must immediately discontinue using the Service.

For the purposes of these Terms of Service, the following capitalized terms shall have the respective meanings assigned to them below:

PLAYTOUCH develops, publishes, and distributes an extensive proprietary catalog of over 400 high-performance HTML5 casual games spanning genres such as Casual Match-3, Brick Breakers, Puzzle, Action, and Arcade.

The Service enables Users to test and play selected games instantly across compatible desktop web browsers, mobile smartphones, tablets, and connected displays without requiring software installation or local app downloads.

PLAYTOUCH reserves the right at any time, without prior notice or liability, to add, modify, update, or remove any game or feature from the Service.

Access to the Service requires compatible hardware and modern web browsing software supporting HTML5 Canvas 2D and WebGL rendering (such as Google Chrome, Apple Safari, Mozilla Firefox, Microsoft Edge, or Samsung Internet), along with a reliable high-speed Internet connection.

Users are solely responsible for ensuring that their hardware, operating system, and Internet connection are compatible with the Service. PLAYTOUCH shall not be held liable for any inability to access or execute games resulting from hardware limitations, outdated browser software, or network failure.

Access to the public gaming portal and sandbox demonstrations is provided free of charge for individual evaluation and enjoyment.

Commercial exploitation, redistribution, bundling, or reselling of PLAYTOUCH games is strictly prohibited unless explicitly authorized under a signed B2B licensing or distribution contract. Enterprise clients seeking commercial licensing, customized white-label platforms, or ad-revenue sharing should submit inquiries through the official B2B portal or via contact@playtouch.net.

Where specific interactive features or partner portals require registration or identifier generation, Users agree to provide accurate, current, and complete information.

Users are entirely responsible for safeguarding the confidentiality of their credentials and session tokens. Any action carried out through a User's session or credentials shall be deemed to have been executed by that User. In case of suspected unauthorized access, Users must notify PLAYTOUCH immediately at contact@playtouch.net.

The Service is strictly reserved for lawful, personal, and fair entertainment. Users agree not to engage in any behavior that impairs the integrity, availability, or security of the Service.

All intellectual and industrial property rights covering the Service, its architecture, and its content—including, without limitation, all video games, character designs, source code, game mechanics, visual assets, 2D/3D sprites, soundtracks, sound effects, text, logos, trademarks, and domain names—are the exclusive property of SAS PLAYTOUCH or its licensors.

Games are authored utilizing performant HTML5 architecture exported from Scirra Construct 2 with proprietary PLAYTOUCH JavaScript wrappers. Nothing in these Terms of Service shall be construed as conferring, by implication, estoppel, or otherwise, any license or ownership right to any User, partner, or third party.

Any reproduction, representation, adaptation, modification, public display, distribution, or commercial exploitation of all or part of the Service or its Content without the express prior written consent of SAS PLAYTOUCH is strictly prohibited and constitutes an infringement punishable by civil and criminal law.

PLAYTOUCH deploys high-standard commercial engineering to maintain optimal performance and availability across global CDN networks. However, the Service is delivered on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express or implied.

PLAYTOUCH does not guarantee that the Service will operate without interruption, latency, or bugs. Access may be momentarily suspended for technical maintenance, software upgrades, or infrastructure maintenance.

Under no circumstances shall PLAYTOUCH be liable for indirect, incidental, consequential, punitive, or special damages, including loss of data, loss of business opportunity, or device malfunction resulting from the use or inability to use the Service, even if advised of the possibility of such damages.

These Terms of Service apply for an indefinite term from the moment the User first accesses the Service.

PLAYTOUCH reserves the right, at its sole discretion, to terminate or suspend access to the Service, temporarily or permanently, without notice or indemnity, in the event of a breach of these Terms of Service (including unauthorized scraping, reverse engineering, or cyber intrusion).

In accordance with Article L. 221-28 (13°) of the French Consumer Code and the European Consumer Rights Directive (2011/83/EU), the 14-day statutory right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgment that they lose their right of withdrawal.

By initiating and playing any digital game or sandbox demo on the Service, Users expressly acknowledge and agree that digital performance begins immediately, thereby waiving any statutory withdrawal rights.

The processing of personal and non-personal data collected during your use of the Service is governed by our comprehensive Privacy Policy, accessible at https://playtouch.net/privacy-policy.

PLAYTOUCH complies with the General Data Protection Regulation (GDPR - EU 2016/679), the French Data Protection Act (Loi Informatique et Libertés), the California Consumer Privacy Act (CCPA), and the Children's Online Privacy Protection Act (COPPA).

Cookies and anonymous telemetry are utilized to measure audience metrics, maintain 60 FPS frame rates, and deliver compliant contextual advertisements.

PLAYTOUCH reserves the right to adapt, update, or revise these Terms of Service at any time to reflect technological developments, regulatory requirements, or catalog additions.

The revised Terms of Service shall take effect immediately upon publication on the Service, with an updated "Last Updated" date. Continued use of the Service following any modification constitutes full acceptance of the updated terms.

These Terms of Service, their interpretation, validity, and enforcement are governed exclusively by the laws of France.

In the event of any claim, dispute, or litigation arising from or related to these Terms, the parties agree to seek an amicable settlement in good faith prior to initiating legal proceedings. If an amicable settlement cannot be reached within sixty (60) days, the dispute shall be submitted to the exclusive jurisdiction of the competent courts within the jurisdiction of the Court of Appeal of Versailles or Grasse, France.

Admissibility of Proof: Server connection logs, telemetry data, and electronic audit records stored within PLAYTOUCH information systems shall be deemed fully admissible as decisive evidence in any dispute or legal proceeding between the parties.
